Indiana: Father, son sue township, fire department
A Randolph County father and son have filed suit against White River Township and its fire department.
According to the suit – filed in Randolph Circuit Court by Muncie attorney P. Gregory Cross – Andrew Bryner and his son, Larry, were seriously injured when their vehicle was struck by a township rescue truck.
Andrew Bryner was driving a pickup truck northbound on Randolph County Road 200-W about 8:45 a.m. on Dec. 14, 2013, when he stopped “in deference to emergency vehicles and other stopped traffic” at the scene of a traffic accident, the suit states.
A northbound rescue truck was approaching the stopped traffic when its driver “lost control of his vehicle and collided with the rear of the (Bryners’) vehicle with great force and violence, causing severe injuries,” according to the suit.
The lawsuit seeks compensation for the victims’ “severe and permanent injuries.”
Andrew Bryner has had medical expenses in excess of $8,000, while medical costs for Larry Bryner, a passenger in his father’s pickup truck, are more than $13,000.
Henry Circuit Court 2 Judge Kit Crane has been appointed special judge in the case. Bloomington attorney Megan Schueler filed an appearance to represent the township and fire department.
