Michigan: Woman who hit Auburn Hills police officer gets jail

A 22-year-old woman who hit an Auburn Hills police officer with her car while resisting arrest in October was sentenced Friday to jail time and probation.

Breianna Smart pleaded no contest to assaulting a police officer, fleeing and eluding, assault with a dangerous weapon and driving without a valid license.

Police said the officer stopped her just after 2 a.m. on Oct. 23 on Opdyke Road near Pontiac Road. When the officer tried to arrest her, she got into her car and backed it into the officer and his patrol car. Smart fled the scene, but was found later the same day.

The officer was not seriously hurt.

Before her sentencing, Smart told the court she knows she made a mistake.

"I'm very sorry," Smart said. "I understand that I made a bad choice."

She also said she has a 1-year-old and an 8-month-old.

"I just want to go home to my kids," she said. "I just want to be a good mother to my kids."

Judge Hala Jarbou told Smart she needed to “grow up" and show respect for authority.

“Not only did you endanger that officer’s life, and everyone else’s life on the road when you took off and fled from the police, you showed complete disrespect for law enforcement. The only thing you were concerned about was yourself,” Jarbou said.

She sentenced Smart to one year in jail and two years of probation on the fleeing and assault charges. Smart was also sentenced to 93 days in jail, with credit for 56 days already served, on the charge for driving without a valid driver's license.

She will also have to pay restitution to the police department, complete 100 hours of community service and go through anger and mental health treatments.
